Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Aeronautical Productions LLC’s websites and services. By accessing or using our website or services, you agree to these Terms.

1. Definitions

  • Company / We / Us / Our: Aeronautical Productions LLC, 2334 44th Street South, St. Petersburg, FL, operating under Media727.com and TheDroneLife.com.

  • Service: Our website(s) and any creative services we provide, including drone photography, videography, design, editing, and related offerings.

  • Client / You: The individual or entity accessing or using our Service.

  • Device: Any device capable of accessing our website or services, such as a computer, mobile phone, or tablet.

  • Affiliate: Any entity that controls, is controlled by, or is under common control with the Company.

2. Acknowledgment

By using our Service, you represent that you are at least 18 years old and legally authorized to enter into binding agreements. If you do not agree to these Terms, you may not use our Service.

Use of our Service also requires acceptance of our Privacy Policy, which describes how we collect, use, and safeguard your information.

3. Payments

  • A 50% non-refundable deposit (or full payment) is required no later than 3 days before scheduled work, unless otherwise agreed in writing (including email or text).

  • The remaining balance is due upon delivery of the final project.

  • Late payments will incur a finance charge of 1.5% per month (18% APR) or $25 per week, whichever is greater, until paid in full.

  • Payments constitute acceptance of these Terms and confirmation that you are authorized to contract with us.

4. Cancellations & Rescheduling

  • Deposits are non-refundable.

  • If a project is cancelled within 72 hours of the scheduled date, the client is responsible for 50% of the total fee.

  • Rescheduling may incur additional costs, especially if travel or crew arrangements are affected.

5. Creative Rights & Intellectual Property

  • All work created by Aeronautical Productions remains the intellectual property of the Company.

  • Clients are granted a non-exclusive license to use the final delivered work for the intended business or personal purpose.

  • Unless otherwise agreed in writing, we may use finished or unfinished work for portfolio, marketing, and promotional purposes.

  • Clients are responsible for securing permissions for any copyrighted music, logos, trademarks, or other IP used in projects.

6. Drone & Safety Compliance

  • All drone operations are conducted in accordance with FAA Part 107 regulations.

  • We reserve the right to decline or reschedule flights if conditions are unsafe, unlawful, or outside FAA allowances (e.g., restricted airspace, flying over people without a waiver, unsafe weather).

  • Client cooperation is required to ensure safe operations.

7. File Delivery & Storage

  • Final deliverables will be provided in agreed formats upon full payment.

  • We retain project files for 30 days after delivery. After this period, we are not responsible for storage. Retrieval of archived files may incur additional fees.

8. Revisions

  • One round of revisions is included, based on the creative direction established prior to the shoot.

  • Additional edits or changes outside of scope will be billed at our standard rates.

9. Limitation of Liability

  • Our maximum liability shall not exceed the amount you paid for the specific service, or $100 if no payment was made.

  • We are not responsible for indirect, incidental, or consequential damages, including lost profits, data, or business opportunities.

  • We are not liable for damages caused by acts of nature, equipment failure, or third-party actions.

10. Disclaimer of Warranties

Our services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee that services will be error-free, uninterrupted, or meet your expectations.

11. Force Majeure

We are not liable for delays or failure to perform due to events beyond our control, including but not limited to severe weather, natural disasters, government restrictions, labor disputes, equipment failure, or other unforeseen circumstances.

12. Governing Law & Venue

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in Pinellas County, Florida, unless otherwise agreed in writing.

13. Dispute Resolution & Arbitration

  • Disputes shall first be attempted to be resolved informally by contacting us.

  • If unresolved, disputes will be settled by binding arbitration in Florida, under the Commercial Arbitration Rules of the American Arbitration Association.

  • The arbitration decision will be final and binding, and judgment may be entered in a court of competent jurisdiction.

14. Severability & Waiver

  • If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

  • Failure to enforce a right does not waive that right in the future.

15. Changes to Terms

We may update these Terms from time to time. If changes are material, we will make reasonable efforts to notify you (e.g., via our website or email). Continued use of our services after updates means you accept the revised Terms.
